Superior Spas Terms and Conditions Definitions
"Conditions" means these terms and conditions and the Special Conditions; "Product" means a product displayed for sale on the Website; "Product Description" means that part of the Website where certain terms and conditions in respect of the individual Product are provided; "Users" means the users of the Website collectively; "We/us" means Superior Spas; "Website" means the website located at www.superiorspas.co.uk . "United Kingdom" means England, Wales, Scotland, Northern Ireland and the Channel Islands and "You" means a user of this Website.
Use of the website
Access
You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.
Our rights
We reserve the right to:
modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.
Description of products
Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.
We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order.
Order cancellation
Please note that you are entitled to cancel this order if you so wish provided that you exercise your right no longer than seven working days after the day on which you receive the Products.
Returns
Please note that when returning rejected goods, the package and contents must in perfect condition. If the product returned is not in fully resaleable condition or the packaging is damaged, we reserve the right to refuse a refund on the item, or deduct up to 30% of the original selling price from the refund amount. This does not affect your statutory rights.
PLEASE NOTE: a 20% re-stocking fee applies in all cases of goods being cancelled. Please call us to arrange collection of the returned goods. No goods will be accepted at the company’s warehouse without prior consent. You are responsible for the cost of returning the goods safely to our warehouse. We will refund your money within 30 days of cancellation, less any delivery costs incurred. Returns outside this period will not be accepted.
Cancellation of made-to-order products
Should you wish to cancel your made-to-order product for any reason, it is unlikely that we could sell it to another customer at full selling price. We will charge a cancellation fee of 20% of the full selling price. In respect of these products our usual refund policy does not apply and products cannot be returned or exchanged unless faulty.
Your Guarantee/Warranty
1. Hot Tubs and Swimming Spa
1.1 One Year Spa shell
Superior Spas are warranted against water loss due to defects in the spa shell for One year from the original date of purchase.
1.2 One Year Electrical Equipment Components
Electrical equipment components (specifically the pumps, heater, and control system) are warranted against malfunctions due to defects in workmanship or materials for one year from the original date of purchase.
1.3 Warranties for Other Components
The spa cover, light bulb, light lenses, fuses, headrests, cabinet finish and filter are warranted to be free of defects in workmanship or materials at the time of delivery. All other factory-installed components, including but not limited to the cabinet, frame, LED light system, stereo and related components, speakers, skimmer, and jets, are warranted against malfunction due to defects in workmanship or materials for one year from the date of purchase.
1.4 In the unlikely event that a part breaks down then simply phone us and we will arrange for the relevant part to be sent out to you. Please note, We can advise on the fitting of any spare part although recommend that a trained engineer fit an electrical or plumbing-specific spare part. We cannot accept any liability regarding the installation of spare parts. Your statutory rights are not affected. Warranty is for parts only (Not Labour Costs)
2. Infrared Sauna and Steam Shower
2.1 One Year Warranty for any manufacturing faults that may occur from the original date of purchase.
2.2 One Year Electrical Equipment Components
Electrical equipment components are warranted against malfunctions due to defects in workmanship or materials for one year from the original date of purchase.
2.3 In the unlikely event that a part breaks down then simply phone us and we will arrange for the relevant part to be sent out to you. Please note, We can advise on the fitting of any spare part although recommend that a trained engineer fit an electrical or plumbing-specific spare part. We cannot accept any liability regarding the installation of spare parts. Warranty is for parts only (Not Labour) Your statutory rights are not affected.
3. Exclusions
Hot Tub, Infrared Sauna and Steam Shower installed in commercial applications are excluded from any coverage whatsoever. This Limited Warranty is void if: the Manufacturer or its designated representative determines that the Hot Tub, Infrared Sauna and Steam Shower has been subjected to alteration, neglect, misuse or abuse, or freight damage caused by the common carrier; or if the failure is caused by accident, acts of God or other causes beyond the control of the Manufacturer. Neglect, misuse and abuse include any installation, operation or maintenance of the Hot Tub, Infrared Sauna and Steam Shower other than in accordance with the instructions contained in the owner’s manual provided with the Hot Tub, Infrared Sauna and Steam Shower, including but not limited to the failure to maintain proper water chemistry and chemical balance and the use of abrasive or improper cleaners. This Limited Warranty does not provide coverage for any item attached to or installed on the Hot Tub, Infrared Sauna and Steam Shower after the date of manufacture, or for gaining access to any component for repair or replacement. Spa units used in a commercial application are excluded from any coverage whatsoever.
Guarantee services will be provided only if the original invoice or sales receipt (indicating the date of purchase, model name and dealer's name) is presented with the defective product within the guarantee period. We may refuse free-of-charge guarantee service if these documents are not presented or if they are incomplete or illegible. This Guarantee will not apply if the model name or serial number on the product has been altered, deleted, removed or made illegible.
This Guarantee does not cover transport costs and risks associated with transport of your product to and from us.
neglect. . Accidents, fire, liquids, chemicals, other substances, flooding, vibrations, excessive heat, improper ventilation, power surges, excess or incorrect supply or input voltage, radiation, electrostatic discharges including lighting, other external forces and impacts.
4. Disclaimers
Except as specifically provided by the laws of individual countries, Superior Spas and its representatives shall not be liable for any injury, loss, cost or other damage, whether incidental or consequential, arising out of any defect covered by this Limited Warranty, including, without limitation, loss of use of the spa and cost for removal of defective product, even if Superior Spas has been advised of the possibility of such damage. The liability of Superior Spas under this Limited Warranty, if any, shall not exceed the original amount paid for the defective product. Coverage under this Limited Warranty shall commence as of the original date of purchase and the duration of such coverage shall not extend for any reason whatsoever beyond the stated time periods. These disclaimers shall be equally applicable to any service provided by Superior Spas and its representative.
